Citizenship In The Several States

There are three forms of American citizenship. Citizens are those native born in America. Naturalized citizens are those not native born but made a citizen by laws of the several states prior to ratification of the Constitution on June 21, 1788, and thereafter by naturalization laws written in Congress. Natural born citizens are those born in America of American citizen parents.

Each form of citizenship existed, just as the nation it self existed, before ratification. One would be mistaken to ascribe any credibility to the false notion that naturalization laws created after ratification, were retroactively applicable to American born citizens of the original several states, wherein by means of the Declaration of Independence and the American Revolutionary War, culminating in a mutual agreement set forth in the Paris Peace Treaty of 1783, and in particular by Article 1, they became free sovereign and independent states. These acts, first forcefully then followed by mutual legal agreement bound by treaty, forever severed any and all allegiance owed to the King by British natural born subjects who were American born in the several states; thereafter each being a free and sovereign citizen of their respective state and concomitantly also a citizen of the United States of America.

Emigrated British subjects became citizens by any existing state naturalization laws. Following the severance of all allegiances to the King, being citizens, they were similarly free from the ties that bind British natural born subjects to the King. Furthermore, had an emigrated subject not been naturalized by state law, they certainly became U.S. citizens with no formal naturalization being necessary, upon the June 21, 1788 ratification of the U.S. Constitution.

Complete severance of all allegiances to the British King is further confirmed by the War of 1812, fought in large part to stop the frequent interception of American ships by the British to forcefully impress American citizens into the British navy, based on renewed claims of allegiance owed to the King, to meet their need for sailors during the Napoleonic Wars. The most famous case involved the H.M.S. Leopard firing upon and boarding the U.S. Frigate Chesapeake on June 22, 1807. Following this highly provocative incident, the Chesapeake was refitted for war and on June 1, 1813 engaged the H.M.S. Shannon near Boston Harbor, where Captain James Lawrence, though mortally wounded, issued the famous command “Don’t give up the ship!”

Obama not eligible: 7 step proof.

1. The Constitution requires that one be a “natural born citizen” to be eligible to serve as president.

2. A natural born citizen is one born in the US of US citizen parents (plural).

Proof: if a “natural born citizen” means just a citizen born in the US irrespective of parentage, as many erroneously assert, then the term citizen must be equivalent to and interchangeable with the term “natural born citizen” in Article 2, Section 1.

Substituting “citizen” for “natural born citizen” renders Article 2, Section 1, of the Constitution fatally flawed by an incompatible contradictory redundancy, conclusively demonstrating that the two terms are not equal.

No person except a “citizen”, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.

3. The framers had no need to define the meaning of a natural born citizen in the Constitution because, as demonstrated by a simple substitution of terms, it is self evident that a “citizen” is not equal to a “natural born citizen”. Given the mutually exclusive distinctions regarding US citizenship, the meaning of a natural born citizen is easily deduced.

4. A citizen is one born in the US. This includes those born of non citizen parents as well as those born of one US citizen and one non US citizen parent. Naturalized citizens are those not born a citizen but later made a citizen. A “natural born citizen” as Constitutionally required by our Founding Fathers to assure the loyalty of the President as best they could, both encompasses and surpasses but is not equal to a citizen, and not being a naturalized citizen, must logically be what remains, which is, one born in the US of US citizen parents (plural).

5. Obama is not born of US citizen parents (plural) because his father is Kenyan.

6. Obama is not a natural born citizen, irrespective of where he was born.

7. Therefore, Obama is not Constitutionally eligible to serve as president of the United States of America.

Presidents with Either Parent Being Foreign Born, Relative to Eligibility as a Natural Born Citizen.

The Supreme Court has never faced a Constitutional dispute directly pertaining to a natural born citizen defined as those born in the U.S. of citizen parents. The phrase “or a Citizen of the United States, at the time of the Adoption of this Constitution” in Article 2, Section 1, ingeniously exempted many proven patriotic citizens born of a foreign parent, as was common at the time, from the citizen parentage requirement. This allowed both Thomas Jefferson and Andrew Jackson, to serve as president. Eligibility based on both ‘soil and blood’ was wisely established by the Founding Fathers, to assure the future loyalty of the president to only America, as best they could. Today this tradition has turned to treachery.

Obama simply decided the law didn’t apply to him, and Congress capitulated. When Congress counted the electoral votes during a joint session held to certify the election, any single individual member of Congress could have and should have opposed Obama for not being a natural born citizen. None did. Those members of Congress apparently now feel they are also above the law. The continuing egregious violations of the 10th amendment are proof enough. Such treasonous disregard for the Constitution has caused several states to formally reassert their sovereignty. Another recent example of Congressional arrogance is evident by their having illegally voted themselves an increase in their cost of living allowance, in direct violation of the 27th amendment. [1]

Confirming the adage that the people get the government they deserve, today’s Congress is truly the best money can buy. We the people are losing more and more of our freedoms and liberty to the abuses of government. The Founding Fathers would shudder in horror and revolt at the taxes taken from us by Congressional robber barons who laugh all the way to the bank, while exempting themselves from the worst of the laws they dare pass for us.

Repealing the 17th amendment would return a state appointed adult presence to the Senate. As originally devised, Senators would have no need to campaign, so they can’t take money. This would return accountability to ‘we the people’ and restore the balance of power the Founding Fathers originally intended. The Framers knew that making Senators accountable to State legislators, comprised of well known members of local communities, greatly reduces corruption. After all, if special interests are unable to purchase similar cooperation from everyone involved in making law, then there’s little value in being generous to just members of the House or the president.

Before ‘Obama the usurper’, the Constitution still seemed to matter. However illusory that delusion may have been since the institution of the heinous 17th amendment which, in 1913 was deceptively allowed to cut deep into the very heart and soul of our Constitution. However, now Congress has unabashedly abandoned all pretext of honoring the Constitution. We the people, have blindly bore the burden of their crushing yoke for far too long without complaint. It’s really no surprise that a criminally complicit Congress has let the worst of their ilk, usurp the presidency.

We the people, can no longer turn a blind eye to the dangerous reality that America is being attacked by enemies from within. Our own untrustworthy elected servants are ready, willing and able to allow even worse abuses to now go unabated, including unrecoverable generational debt and the unconstitutional nationalization of entire industries.

Clearly there is an inherent danger of not demanding that our elected public servants fully honor the Constitution. Should we allow even one part to be ignored, the entire Constitution is diminished. Then soon, another part is ignored, then another and another after that, until eventually the guarantor of our liberty is surrendered and our freedom is gone.

George Washington offered this sage advice on amendments while also warning us against any changes brought by usurpation of the Constitution.

“To preserve them must be as necessary as to institute them. If, in the opinion of the people, the distribution or modification of the constitutional powers be in any particular wrong, let it be corrected by an amendment in the way which the Constitution designates. But let there be no change by usurpation; for though this, in one instance, may be the instrument of good, it is the customary weapon by which free governments are destroyed.”

Beginning in 1789 when George Washington humbly accepted the honor of being our first president, a 220 year precedent has since been established for the president to be a natural born citizen, unless having been exempt from this requirement as a citizen at the time of the adoption of our Constitution. Chester Arthur was recently discovered to have gone to great lengths to hide the fact that he was not eligible, and was the sole exception before Obama.

Obama assumes the Constitution does not apply to him, however he is not above the law. Obama’s Kenyan father precludes him from being a natural born citizen. Obama, and those who aided and abetted him, must be held accountable for knowingly usurping or assisting in the usurpation of the office of the President of the United States of America. We must honor the Constitution.

The United States Constitution was adopted on September 17, 1787. The Constitution was ratified on June 21, 1788. Prior to this date citizenship was established by the state. As of June 21, 1788 each citizen of a state became a citizen of the United States. No formal naturalization was needed. [2]

U.S. Presidents with either parent being foreign born are listed below in chronological order. Only Chester Arthur and Barack Hussein Obama failed to qualify for eligibility to serve as president by not being a natural born citizen.

The Buchanans were Pennsylvania citizens. James Buchanan Sr. became a citizen of the United States when the Constitution was ratified on June 21, 1788. President James Buchanan Jr. was born April 23, 1791 in Pennsylvania. Therefore James Buchanan Jr. was a natural born citizen, born in the U.S. of two U.S. citizen parents.

Well ahead of eventually realizing his greatest political ambition by assuming the presidency on September 19, 1881, Arthur purposefully perpetrated an elaborate fraud to hide the fact that his emigrated Irish father had not become a naturalized US citizen until August 1843, fourteen years after our 21st president was born in 1829 at Fairfield, Vermont. Woodrow Wilson

Derivative citizenship enabled her to automatically become a U.S. citizen after her marriage to Joseph Wilson.
Therefore Woodrow Wilson was a natural born citizen, born in the U.S. of two U.S. citizen parents.

A congressional Act of February 1855, stated that “any woman who might lawfully be naturalized under existing laws, married, or shall be married to a citizen of the United States, shall be deemed and taken to be a citizen.” [Act of February 10, 1855, 10 Stat. 604, section 2] This was a form of derivative citizenship.

The Constitution Proves That a Natural Born Citizen Means Those Born In the U.S. of Citizen Parents.

The Constitution of the United States of America, Article 2, Section 1, Clause 5.
“No person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty-five Years, and been fourteen Years a Resident within the United States.”

Central to the current controversy over our de facto president’s eligibility is the fact that the Founding Fathers correctly deemed it unnecessary to define a “natural born citizen” in the Constitution. Some, incorrectly claim this is cause to assert that we can not know what a natural born citizen means. However our Founding Fathers truly had no need to include a separate, well known and redundant definition of a natural born citizen. The very framework of the Constitution precludes any possible meaning for a natural born citizen other than those born in the U.S. of citizen parents.

The Founding Fathers added the phrase “or a Citizen of the United States, at the time of the Adoption of this Constitution” to Article 2, Section 1, in order to exempt many proven patriots of the time including themselves, as it was common then to have been born to foreign parents, from the requirement of being a natural born citizen. This was done so that each patriot might continue serving their country honorably in every way possible. This exemption was truly fortuitous, as it enabled both Thomas Jefferson and Andrew Jackson, each born of a foreign parent and therefore not a “natural born citizen” to be eligible to serve as president.

“Permit me to hint, whether it would not be wise & seasonable to provide a strong check to the admission of Foreigners into the administration of our national Government; and to declare expressly that the Command in chief of the American army shall not be given to, nor devolve on, any but a natural born Citizen.”
—John Jay, Founding Father, President of the Continental Congress from 1778 to 1779, and the first Chief Justice of the United States Supreme Court, in a letter to George Washington, an attendee of the Constitutional Convention, July 25, 1787.

The Founding Fathers wisely chose to require the highest form of citizenship possible, that being both soil and blood, to assure the loyalty of the president and commander in chief of the armed forces, to only the United States as best they could. It stands to reason that if just citizenship was all that they intended, irrespective of parentage (as is the case in English common law for natural born subjects), there would have been no need for them to have included the exemption.

Therefore, the fact that they did add the exempting phrase “or a Citizen of the United States, at the time of the Adoption of this Constitution” serves as self evident conclusive proof that a “natural born citizen” means those born in the U.S. of citizen parents (plural)!
